These terms and conditions ("Agreement") govern your use of the Preppy mobile application ("Application" or "Service") and are legally binding between you ("User") and Kevin Waltz ("we"). By using the Application you confirm you have read, understood, and agreed to this Agreement. If you do not agree, you are not permitted to use the Application.

Medical Disclaimer — Please Read Carefully

Preppy is not a medical product, medical device, or healthcare service under EU MDR 2017/745 or the German MPDG. The Application is intended solely for personal, non-medical self-tracking. It does not provide medical advice, diagnoses, or treatment recommendations and does not establish a doctor-patient relationship.

Not a Medical Device

Preppy is expressly not a medical device within the meaning of EU MDR 2017/745 or the German Medical Devices Act (MPG/MPDG). It has not been tested, certified, or approved for any medical or clinical purpose. All data and outputs generated by the Application are based solely on information you enter and are not clinically validated.

No Medical Advice

• The Application does not provide medical advice of any kind.

• No information displayed in the Application is to be understood as a recommendation to change a treatment, medication, or therapy.

• The Application does not establish a doctor-patient relationship or any other professional healthcare relationship.

Always Consult a Healthcare Professional

For all health questions or concerns, always consult a doctor or licensed medical professional. Never disregard professional medical advice, and do not make health decisions solely on the basis of this Application.

No Liability for Health Decisions

Kevin Waltz expressly disclaims all liability for harm arising from:

• reliance on data or information from the Application

• health or medical decisions based on Application data

• inaccuracies or errors in data you have entered

• delays in seeking professional medical advice

Use is entirely at your own risk.

Accounts and Membership

You must be at least 16 years old to use the Application. You are solely responsible for your account security and all activities under it. Providing false information, security breaches, or conduct damaging to our interests may result in account suspension or deletion. Notify us immediately of any unauthorized access at hello@kaevin.io.

User Content

We do not own content you submit to the Application. You bear sole responsibility for its legality, accuracy, and intellectual property. You grant us a limited license to process your content solely for service delivery. We may remove content that violates our policies or is harmful.

Use of Data for Scientific Research

We may use aggregated, anonymized or pseudonymized data for scientific research and to improve the Application, with the following safeguards (Art. 89 GDPR):

• Data is anonymized or pseudonymized where technically feasible.

• Research results are published in aggregated form only.

• Data is not used for commercial profiling or advertising.

Legal basis: Legitimate interests (Art. 6(1)(f) GDPR) with Art. 89 GDPR and § 27 BDSG. You may object at any time at hello@kaevin.io.

Accuracy of Information

We may correct errors or update information in the Application at any time without notice. We have no obligation to update information beyond what is required by law.

Links to Other Resources

Links to external resources do not imply endorsement or affiliation. We accept no liability for third-party content, products, or services.

Prohibited Uses

Use of the Application for the following purposes is prohibited:

• Unlawful actions or inciting third parties to commit them

• Violation of third-party rights, in particular intellectual property rights

• Harassment, discrimination, or intimidation of any person

• Transmission of malware or circumvention of security features

• Submission of false or misleading information

• Spam, phishing, or abusive scraping

We may terminate your access for violations.

Intellectual Property

All trademarks, graphics, logos, and other content of the Application are owned by Kevin Waltz or its licensors. This Agreement transfers no intellectual property rights to you. Any reproduction or use without express written consent is prohibited.

Disclaimer of Warranty

The Service is provided "as is" without warranties of any kind, express or implied, including no guarantee of uninterrupted, error-free, or secure availability. Use is at your own risk.

Limitation of Liability

To the fullest extent permitted by law, Kevin Waltz is not liable for indirect, incidental, special, or consequential damages, regardless of the theory of liability. Total liability is limited to one euro or amounts actually paid in the prior month.

Indemnification

You agree to indemnify Kevin Waltz and its representatives against third-party claims arising from your content, your use of the Application, or your willful misconduct, including reasonable attorney's fees.

Severability

Should any provision of this Agreement be or become invalid, the remaining provisions shall remain unaffected and in full force.

Governing Law and Jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Exclusive jurisdiction: Berlin, Germany.

Assignment

You may not transfer your rights or obligations under this Agreement without our prior written consent. We may transfer ours in connection with a merger or sale of our business.

Amendments

We reserve the right to modify this Agreement at any time. Changes will be published in the Application and the update date will be adjusted. Continued use constitutes acceptance of the changes.

Acceptance

By using the Application you agree to all terms of this Agreement. If you do not agree, you are not permitted to use the Application.
